MyData Terms of Service
These terms are an agreement between you and I Own Software LLC ("we", "us") covering the MyData file-sync product — the hosted service at app.mydata.iownsoftware.com, the self-hosted MyData server, the desktop agents, and this website. By creating an account, buying a license, or using the software, you accept them.
1. The two ways to run MyData
- Hosted: we run the MyData service for you. You get an account with the storage allotment, version-history retention window, and device count of your plan. Your files are stored on our infrastructure under section 2.
- Self-hosted: you buy a perpetual license, once. You run the MyData server on your own hardware and your files never reach us. The license never expires and includes one year of software updates; after that you may optionally buy further update coverage — if you don't, your software keeps working exactly as it is. Nothing about the self-hosted license renews or charges automatically.
A self-hosted license is for your own (personal or in-house business) use: it doesn't permit reselling MyData, offering it to third parties as a service, or redistributing the software.
2. Your files stay yours
You keep all rights to the files you sync. We claim no ownership and no license to them beyond what is technically required to run the service for you: storing, transmitting, versioning, deduplicating, and — when you use those features — generating previews and serving the share links and shared-folder access you create.
On the hosted service your file content is encrypted at rest in our storage layer. The service holds the encryption keys so it can do its job (restore versions, serve downloads, previews); it is not a zero-knowledge system, and we describe the details honestly in the Privacy Policy. Our staff do not access your file content except as needed to operate the service, investigate abuse, or comply with law.
Sharing is under your control: folder members and guests you invite get the access level you assign, and anyone holding a share link you create can download that file. Revoking a member, guest, or link ends that access going forward.
3. Your responsibilities
- Keep your credentials and your devices' access safe; what happens under your account is your responsibility until you tell us it's compromised.
- Sync only content you have the right to store and share.
- Keep independent backups of anything critical. MyData keeps version history within your plan's retention window, but no sync product is a substitute for a backup you control.
4. Acceptable use
Don't use MyData to store or distribute unlawful content, malware, or content that infringes others' rights; don't probe, overload, or interfere with the service or other tenants; don't resell hosted accounts. We may throttle or suspend accounts that threaten the integrity of the service, and will tell you when we do unless the law prevents it.
5. Suspension and termination
You can stop using the hosted service at any time; contact support@iownsoftware.com to close your account, and we delete your stored content per the Privacy Policy. We may suspend or terminate hosted accounts for material breach of these terms, non-payment, or legal necessity. On termination you may export your data during a reasonable wind-down period, except where the law requires immediate removal. Termination of a hosted account never revokes a self-hosted perpetual license you have bought.
6. Availability
We operate the hosted service with reasonable skill and care, but it is provided without a guaranteed uptime level: maintenance windows, upstream failures, and factors outside our control can interrupt it. The desktop agents are built to catch up automatically when connectivity returns.
7. Fees
- Hosted plans are billed at the prices shown when you pick or change a plan. Storage beyond an allotment is charged only as described on the pricing page current at that time.
- Self-hosted license: a one-time payment. The optional updates renewal is a separate one-time purchase each time you choose to make it — we do not auto-charge it.
- Payments are processed by Stripe; we never see your full card number. Prices exclude any taxes we are required to collect. Except where the law says otherwise, fees are non-refundable once the service or license has been delivered — if something's wrong, write us; we're reasonable.
8. Warranties and liability
MyData is provided "as is" without warranties of merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent the law allows, we are not liable for indirect, incidental, special, or consequential damages, or for loss of data where section 3's backup responsibility applies; and our total liability under these terms is capped at the amounts you paid us for MyData in the twelve months before the claim. Nothing in these terms excludes liability that cannot lawfully be excluded.
9. Changes
We may update these terms as the product evolves. The current version (with its version number and effective date) always lives at this address; material changes to the hosted service will be announced to account holders with reasonable notice. Continuing to use MyData after a change takes effect means you accept it. The terms in force when you bought a self-hosted license keep governing that license.
10. Governing law
These terms are governed by the laws of the State of Utah, USA, excluding its conflict-of-laws rules. Disputes belong to the state or federal courts located in Utah, and each of us consents to their jurisdiction.
